Duty of vigilance

On 17 June 2025, the Paris Court of Appeal handed down a particularly groundbreaking ruling upholding the decision of the Paris Court of First Instance, which had ordered La Poste to revise its due diligence plan in a number of key areas, in light of the obligations arising from Article L.225-102-4 of the French Commercial Code (which became L.225-102-1 in 2025).

Compensation for economic loss resulting from the use of an AI system

Among the crucial issues raised by the use of Artificial Intelligence Systems (hereinafter referred to as ‘AIS’), the compensation of economic damages resulting from these AIS raises many questions and involves both the interpretation of special rules arising from Regulation (EU) 2024/1689 on Artificial Intelligence (hereinafter referred to as ‘AI Act’) and other legislation, adapting the rules of civil liability under ordinary law to delimit the liability of each player in the artificial intelligence (AI) value chain. Difficulties are also emerging on the evidential front, due to the plurality of these players and the often opaque nature of AIS, which are technologically complex and sometimes trained using millions of data sets.

Green finance and sustainable performance: asset management and the climate challenge

Rima Maitrehenry, Partner in Fund Formation, spoke at the ‘Objective Decarbonation Summit – 10 years of the Paris Agreement’, organised by the Forum de l’Engagement at the French Ministry of the Economy and Finance.

She co-hosted a round table devoted to the challenges of green finance, to decipher the latest developments in the SFDR and Taxonomy frameworks and the effect of these regulations on sustainable investment strategies.
